Propertyowner Services AG and the Swiss Property Owners Association jointly operate the website www.propertyowner.ch and provide the services offered on it (hereinafter “we”). 2 · What data we process
IN BRIEF
We receive most data directly from you. Some information comes from publicly accessible sources, such as the land register when we value a property.
We primarily process personal data collected in connection with the operation of our website and applications, as well as data arising from our business relationships with customers, members, business partners and other parties involved. We obtain this data mainly directly from you.
Data you provide to us
- Name, address, email address and telephone number;
- information relating to your user account and membership;
- information about real estate and land: address and location, floor area, number of rooms, year of construction, condition, standard of finish, renovations and features;
- purchase, sale and financing interests, as well as financial information entered into our calculation tools;
- the content of your enquiries, messages and viewing requests;
- contractual and transaction information.
Data we receive from third parties
- Information from publicly accessible sources such as the media and internet;
- information from public registers such as the commercial register, debt-enforcement register and land register;
- information connected with administrative or court proceedings;
- creditworthiness information where we enter into a business relationship with you personally;
- information from property platforms and from providers of property and market data;
- references and information from sales and other contractual partners where required to enter into or perform a contract.
Data generated when you use our website
IP address, information about your device and its settings, browser type and operating system, cookies and comparable technical identifiers, the date and time of your visit, pages and content accessed, functions used, referring websites and approximate location data derived from your IP address.
Information that is required
Certain information is mandatory for a business relationship. Without it, we are generally unable to enter into a contract. The website likewise cannot be used if technically necessary data, such as the IP address, is not transmitted.
3 · Applicable law, purposes and legal bases

We process data in order to respond to your enquiry, provide our services, comply with legal obligations, pursue a legitimate interest or where you have given us your consent. You may withdraw your consent at any time.
Applicable data-protection law
We process personal data in accordance with applicable data-protection law, in particular the Swiss Federal Act on Data Protection (FADP). Where the European Union’s General Data Protection Regulation (GDPR) applies in an individual case, we also comply with its requirements.
Overview of purposes and legal bases
We process your data solely for specified purposes and where permitted by law. The relevant basis is, in particular, the performance of a contract or steps taken prior to entering into a contract, statutory obligations, our legitimate interests where your interests do not override them, and your consent.

Where you have given us your consent, we process your data within the scope of that consent unless another legal basis applies. You may withdraw your consent at any time. Processing carried out before the withdrawal remains unaffected.
4 · Disclosure to third parties
IN BRIEF
Service providers receive only the data they need to perform their tasks. If you use an offer from one of our partners, we pass the required information to that partner. The partner is then responsible for any subsequent processing.
a) General principle
We do not sell your personal data. We engage third parties and affiliated companies as processors. Recipients include, in particular:
- Affiliated companies (propertyowner.ch financial AG, propertyowner.ch family office AG);
- the Swiss Property Owners Association;
- IT, hosting, CDN and cloud service providers;
- CRM, email and newsletter service providers;
- providers of analytics, tracking, conversion and advertising services;
- property-valuation and market-data providers;
- banks, payment providers, financing partners and debt-collection agencies;
- accounting, fiduciary and auditing firms;
- legal and tax advisers;
- authorities and courts where we are legally required to disclose information.
We contractually require these recipients to comply with data-protection provisions and confidentiality obligations.
b) Partners and cooperation partners
Our website also contains offers from companies and partners in the real-estate sector. It will be clear to you whenever an offer originates from a third-party provider.
If you use such an offer, we pass the personal data required for it, such as your name, your role and your message, to the relevant partner. The partner is responsible for the subsequent processing of the data. Its privacy policy applies.
c) Parties involved in a property transaction
Where necessary to carry out a transaction, we disclose information to the responsible real-estate adviser, the property owner or other persons involved in the property transaction.
d) Links to social media
The social-media icons on our website are simple links. The relevant provider only learns which website you came from when you click one of them. The provider may use this information for its own purposes. We do not receive any information in return.
5 · International data transfers
IN BRIEF
The website is operated on servers in Switzerland. Data is transferred to the EU and the USA for content delivery, reach measurement, advertising measurement and certain embedded content. Such transfers are protected, among other safeguards, by standard contractual clauses.
In connection with our data processing, personal data may also be transferred to companies abroad. These companies are generally subject to data-protection obligations equivalent to ours.
Where a country’s level of data protection does not correspond to that of Switzerland or the European Economic Area, we conduct a prior risk assessment and contractually ensure comparable protection, for example through the European Commission’s standard contractual clauses or other measures provided by law.
International service providers may process data in countries other than the country in which the direct contractual partner is based. The countries to which individual services transfer data are listed in the table in section 10.
6 · Retention and deletion
IN BRIEF
Usage data is generally stored for twelve months. Contractual and accounting data may be retained for up to ten years due to statutory retention obligations.
We retain personal data only for as long as required to fulfil the relevant purpose or for as long as statutory retention obligations apply.

As soon as contractual data is no longer needed to provide our services, we restrict access to it and use it only for accounting and tax purposes.
7 · Data security
We take appropriate technical and organisational measures to protect your data against loss, unauthorised access, misuse and alteration. Data transmitted through this website is encrypted using HTTPS or TLS. Passwords are not stored in plain text.
Contractual partners who are granted access to your data are likewise required to comply with data-protection provisions. If enquiries are forwarded to an affiliated company, your data will also be treated confidentially there.
Despite appropriate security measures, absolute protection cannot be guaranteed when data is transmitted or stored electronically.
Note on emails
Emails may, in certain circumstances, be read or altered without this being detected during transmission. Spam filters may also reject messages. We therefore recommend using the protected area of your user account for particularly confidential documents.
8 · Your rights
IN BRIEF
You may request access, rectification, deletion and, where applicable, the disclosure or transfer of your data, and you may withdraw any consent you have given. An email to info@propertyowner.ch is sufficient; no special form is required and there is no charge.
To enable us to process your request unambiguously, we may ask you to provide proof of identity and details of the data to which your request relates.
We generally respond to requests within 30 days. This period may be extended where there is a high volume of requests or where legal or technical clarification is required. In such a case, we will notify you of the delay at least in text form.
a) Access and data portability
You may request information at any time about the data we process concerning you. Where your data is processed by automated means and you have either consented to the processing or provided the data to us in connection with a contract, you may request that we provide the data to you in a commonly used file format.
We may restrict or refuse access where this is required by legal obligations or overriding interests of our own, of the public or of third parties.
b) Rectification and deletion
You may have inaccurate data corrected and ask us to delete your data, provided that no statutory retention obligation or other legal basis prevents deletion. Exercising these rights may affect existing contractual relationships and may, for example, result in early termination or corresponding costs.
c) Withdrawal of consent
You may object to the processing of your data for analytics and advertising purposes. As no cookie banner is currently available on our website, you can most effectively exercise this right through your browser. Section 10 describes the available options for each service.
d) Legal remedies
You may enforce your rights in court or contact the competent supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC), www.edoeb.admin.ch.
9 · Specific data-processing activities
Website operation and log files
This website is hosted on servers in Switzerland by Akenes SA (Exoscale), Boulevard de Grancy 19A, 1006 Lausanne. The application is developed and operated internally by Propertyowner Services AG. We additionally use Cloudflare for content delivery, acceleration and protection of the website (see section 10).
When you visit our website, the following information is logged automatically: the name of your internet service provider, your IP address, browser type and version, operating system, date and time, page accessed, status code and volume of data transferred, referring website and search terms used.
This data cannot readily be linked to specific individuals and is not combined with other data sources. The log files are used for the technical operation of the website and the security of our systems. This is in our legitimate interest. It is not possible to object to this processing, as the website cannot technically be operated without this data.
Contact form, email and telephone
Information you submit through a contact form, such as your name, email address and telephone number, is stored and used to process your enquiry. If you contact us by email or telephone, we process, in particular, your contact details and the subject, content and time of your message.
This data may be stored in our customer, CRM and communications systems where necessary to handle your enquiry or a potential business relationship. The legal bases are steps taken prior to entering into a contract and our legitimate interest in processing your enquiry and any follow-up questions.
Property enquiries, sales documentation and viewings
If you are interested in a property, request sales documentation, ask a question about a property, request a viewing or register for a waiting list, we process the information needed for this purpose: your contact details, the property concerned, the time and source of the enquiry, the content of your enquiry and your preferred viewing times.
Where necessary, we pass this information to the responsible real-estate adviser, the property owner or other persons involved in the transaction.
Online services: valuations and calculations
In our valuation and calculation tools, you enter data including contact, property and financial information. We process this information to provide the requested service. Some online services are offered jointly with third-party providers or affiliated companies. In such cases, we pass the data required for the service to them.
The legal bases are steps taken prior to entering into a contract and the performance of any resulting contract.
Wüest Partner
For property valuations, market analyses and property-specific market information, we use services, data and valuation models provided by Wüest Partner AG, Bleicherweg 5, 8001 Zurich, Switzerland.
The property information required for a valuation may be processed or transferred to Wüest Partner systems, including the address and location of the property, property type, living and land area, number of rooms, year of construction, condition, features and other value-relevant property information. Contact details and other information directly relating to an individual are transferred only where required for the relevant service.
No automated individual decision-making
Our valuation and calculation tools provide estimated values and metrics for guidance. As a general rule, we do not make decisions about individuals based solely on automated processing where those decisions have significant legal or comparable effects. Should we use such procedures for individual services, we will inform the persons concerned in accordance with the applicable legal requirements.
User account and membership
You may register on our website and create a login. We collect the information you enter, such as your name, email address and telephone number, together with a user identifier and details of your membership. Your user account gives you password-protected access to the basic data we hold about you and to our services.
As part of membership of the Swiss Property Owners Association, we may send you information about services, real estate, events and offers. The legal basis is performance of the contract or your consent. You may withdraw your consent at any time with effect for the future.
“Member Market Weekly” and “Member Market Invest” newsletters
You may subscribe to our free newsletters through the website. We collect your email address and, where applicable, additional contact details. We require these details to send and deliver the newsletter.
We use Mailchimp (Intuit Inc., USA, or The Rocket Science Group LLC) for technical delivery. Your email address and delivery and interaction data are processed on the provider’s systems; processing in the USA is possible.
By subscribing, you also agree that we may statistically analyse how you use the newsletter, in particular whether an email was opened or a link in it was clicked, in order to improve the newsletter continuously.
If you register as a member, we subscribe you to the members’ newsletter. It informs you about new articles, events and offers. The legal basis is your consent or our legitimate interest in informing our members within the scope of the existing customer relationship.
10 · Cookies and analytics services
IMPORTANT INFORMATION ABOUT THE CURRENT TECHNICAL SETUP
At present, our website does not offer an option to make an individual selection in advance through a cookie-consent banner. Analytics and marketing technologies may therefore be loaded when a page is first accessed and may set the corresponding cookies and identifiers. We base this processing on our legitimate interest in analysing, improving and promoting our services. You may restrict storage at any time through your browser settings or delete cookies that have already been stored. We are reviewing the introduction of a consent solution; once it is available, we will update this privacy policy.
How cookies work
Cookies are text files stored by your browser on your device when you visit our website. They do not cause damage and do not contain viruses. Many of the cookies we use are session cookies and are deleted automatically after your visit. Others remain stored on your device until you delete them. This enables your browser to be recognised on a later visit and, for example, to retain your language or location settings. Technologies comparable to cookies, such as the browser’s local storage, may also be used.
Managing cookies in your browser
Cookies are stored on your device and can be managed by you. You can delete cookies or configure your browser to restrict or completely block them. Instructions are available in your browser’s help section (Google Chrome, Apple Safari, Microsoft Edge, Mozilla Firefox). If you disable cookies for our website, some functions may no longer be fully available.

11 · Amendments
We may amend this privacy policy at any time. An amendment may be necessary, in particular, if we introduce new services, change our data-processing activities, use new technical services or discontinue existing ones, or if legal requirements change. The version published on this page at the relevant time applies.
We do not provide separate notification of every amendment. We announce material changes in the members’ area and in the members’ newsletter.
